Terms of business

The terms on which we supply recruitment services, and the terms on which you use this website.

About us

Sowers Recruitment Ltd, company number 00000000, VAT number GB 000 0000 00, registered at 1 Example Street, London, EC1A 1AA. We act as both an employment agency (for permanent placements) and an employment business (for temporary workers) as defined by the Employment Agencies Act 1973.

For candidates

  • Our services are free to candidates. Charging a work-seeker a fee for finding them work is prohibited by the Conduct of Employment Agencies and Employment Businesses Regulations 2003, and we do not do it in any form
  • We will not send your CV to any employer without your consent for that specific role
  • We will tell you the identity of the employer, the nature of the role, the pay, and the length of any assignment before you agree to it
  • You are under no obligation to accept any role we put to you, and declining will not affect what we offer you next

For clients — permanent placements

  • ⚠️ Insert your fee structure. Typically a percentage of the candidate's first-year gross remuneration, tiered by salary band or role level
  • ⚠️ Insert your rebate terms — commonly a sliding scale over the first 8 to 12 weeks. Specify whether a replacement is offered before a refund
  • ⚠️ Insert your introduction period — the window in which an engagement of a candidate we introduced attracts a fee, commonly 12 months
  • Invoices are payable within ⚠️ [insert] days of the candidate's start date
  • We reserve the right to charge interest on late payment under the Late Payment of Commercial Debts (Interest) Act 1998

For clients — temporary workers

  • Temporary workers are supplied on an hourly charge rate comprising the worker's pay, employer's National Insurance, holiday pay, pension contributions and our margin. We will break this down for you on request
  • Timesheets must be authorised weekly. Authorisation confirms the hours worked and the satisfactory performance of the assignment
  • ⚠️ Insert your temp-to-perm transfer fee terms, and confirm you offer the extended hire period alternative required by Regulation 10
  • Agency Workers Regulations 2010 rights apply after 12 continuous calendar weeks in the same role. We will manage this with you

Our obligations to clients

  • We verify each candidate's identity and right to work in the UK before introduction
  • We obtain the qualifications and references appropriate to the role, and tell you what we have and have not been able to verify
  • We take reasonable steps to confirm a candidate is suitable, but the decision to engage them, and any further vetting, remains yours

Liability

⚠️ Your solicitor must draft this clause. It should cap liability at a stated figure or a multiple of fees paid, exclude indirect and consequential loss, and expressly not exclude liability for death or personal injury caused by negligence, or for fraud — those exclusions are void.

  • This site and its content are our property or licensed to us. You may not copy or republish it commercially without permission
  • Vacancy details are supplied by clients and believed accurate at the time of publication, but we do not warrant that any advertised role remains available
  • Salary guidance published on this site is indicative market information, not an offer or a guarantee of what any employer will pay

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
